Terms & Condition

1. The applicant is required to read thoroughly the conditions; policies and procedures; code of ethics and business opportunities of the company, as given from the website in the name of "www.myamw.in". This application/agreement form is to be considered as an authentic and legally binding document. This contract is in between the applicant (hereinafter referred to as Distributor) and Arumaitri Wellness Private Limited (hereinafter referred to as the Company).

2. If the applicant agrees to add hereto and abide by the conditions mentioned, hereunder and in the website named "www.myamw.in", he/she shall become a Distributor on purchase of the prescribed product by way of a cross Demand Draft/ NEFT/RTGS or given Payment Mode.

3. The applicant should have completed 18 years of age and shall be competent to enter into a contract as provided in the “Indian Contact Act, 1872”

4. If the applicant is under 18 years of age then "minor detail" must be filled by the parents/guardian of the applicant and giving their consent.

5. If the applicant is a Partnership Firm/Private Ltd. Company, then the applicant has to provide all necessary documents pertaining to Firm/Company during their membership.

6. If anybody makes payment in cash. It will be at own risk and under no circumstances, will be answerable to such unauthorised cash payment.

7. There is NO registration fee or any renewal charges to continue as a Distributor.

8. The Distributor will be eligible for incentives or income pay only as per the volume of sales done by them and that too is also subject to the eligibility norms to the Distributor on only their joinings the company with minimum two direct referrals.

9. Product delivery period on an average will be a minimum of 7 days to 15 days from the date of purchase, or more time as per the billing address to Distributor.

10. Distributor is to act independent and nothing contained in this Agreement shall be construed to-

1. a) give either party the power to direct and control the day-to-day activities of the other;

2. b) constitute the parties as partners, joint ventures, co-owners or otherwise; or

3. c) allow Distributor to create or assume any obligation on behalf of Company for any purpose.

Distributor is not an employee of Company and is not entitled to any employee benefits. Distributor shall be responsible for paying all income taxes and other taxes charged to Distributor on amounts earned hereunder. All financial and other obligations associated with Distributor's business are the sole responsibility of Distributor.

11. The company will approve the Distributor by issuing of official receipt via online registration, which will carry a password and an identification number known as "Distributorship”, as generated by company. This password and Distributor ID shall be used for all their transaction and correspondence with the company. The Distributor ID once generate cannot be altered.

12. The company will, in no case, entertain and communicate without Distributor ID.

13. Trimming and service charge will be deducted as per company norms specified and TDS will be deduced as per the applicable rates by the Indian Government.

14. If a Distributor is a partnership firm, they have to submit relevant partnership deed and other relevant documents.

15. All individual Distributors should adhere to rules and regulation formed by the organisation and if any of the Distributors is found guilty of not observing the same, then he/she shall be terminated from the company.

16. The company reserves all the rights to terminate a Distributor.

17. Once a Distributor is terminated they cannot enter into any of the company premises/meeting location(s) and his/her incentive/income will be stopped with immediate effect.

18. The Distributor shall provide facts, act bona fide and fulfil provisions related to the terms and conditions of the company. They shall uphold the integrity and decorum of the company, and shall maintain good relation with other clients.

19. The Distributor shall always behave and act in a dignified manner befitting the status of a member of a reputed and leading network marketing company of the country.

20. The Distributor shall not compel or induce or mislead any person with any false statements/promise to join in the company as a Distributor.

21. The company will not be answerable for any promises, assurance given by any Distributor to any person, unless it is in accordance with the approved sales plan and terms.

The applicant is advised to go through the website of the company along with the brochures and notices issued by the company and have full information on all the documents.

22. The applicant/Distributor shall ensure that all the information/furnished to the company is correct and properly entered. Request for correction shall be furnished to the company in due time.

23. Distributor’s sponsor or placement details will not be entertained once the payment statements are processed.

24 The company reserves the right to reject any application of applicant at its own discretion.

25. The company reserves the right to modify terms and conditions, product, schemes, business and policies, giving prior notice through its website "www.myamw.in", which shall be binding on all Distributors of the company. Hence, they are advised to keep themselves updated.

26. The terms and conditions within above mentioned shall be governed in accordance with the law in force in the territories of India. Disputes, if any, shall be subject to the court of Lucknow only.

27. If any dispute arises between the parties hereof regarding interpretation of any terms and conditions or as to incentives, income, etc., related to business of the company, the same shall be referred to arbitration and the arbitration shall be governed by the 'Arbitration And Conciliation Act, 2010'.

28 The Distributor has to provide all the correct information in the terms, the mobile number mentioned should be in a working condition and if it is found during verification that number mentioned in the form is in false/non-working condition or any other information filled up in the membership form is not true, the application will be rejected and Distributorship will be forfeited with immediate effect.

29. If due to any change in government policies and enactment of law, the business of the company is stopped, the company will not liable for any kind of claims, reimbursement and compensation.

30. Distributor must not use ARUMAITRI logo or brand name of the company without prior approval of the company.

31 :-

1. a) This agreement constitutes the entire agreement between the Distributor and the Company and no other promises, representative, guarantees or agreement of any kind shall be valid unless giving in writing.

2. b) For all purposes, only the English version will be taken as the official copy. No printing material by Distributor is allowed to be circulated without the written approval of the Company; the Distributor shall be liable to be terminated under the condition aforesaid.

3. c) Company, shall not be liable for any incident or consequential damages caused by breach, cancellation or suspension of the agreement, whether or not the possibility of such damages is known the company.

4. d) Company reserves it's right to amend rules and regulations

5. e) Company shall make no refund of any kind.

6. f) All payment should be accepted in the form of DD/online transaction only and payable at lucknow office.

7. g) Company shall not be responsible for any cash payment made at any place or payment made to any person.

8. h) The company reserves all rights to alter, amend or revise any of the terms and conditions and may notify the Distributor of any changes to the terms and conditions in any manner it considers appropriate.

9. i) Any change in the address of the Distributor shall be immediate to the company in writing within 7days of such changes.

10. j) In all correspondence, the agreement number should be quoted by the Distributor.

11. k) All remedies of the company under the agreement whether provide herein or conferred by statute, Civil Law, Custom, Trade, or usage are cumulative and not alternative and may be enforced successively concurrently.

32. Photo copy of self-attested ID proof and residence proof(KYC)are must to be attached with the application form.
